Temporary Business (Long Stay) – Service Sellers

The purpose of this visa is to allow representatives of overseas suppliers of services to stay in Australia for between six (6) and 12 months. The reason for the stay must be to negotiate, or enter into, agreements to supply services in Australia.

This visa is for company representatives of overseas suppliers of services. You can only be selling or negotiating the sale of services - not products.

Example: A sales representative of a company who is negotiating the supply of training services in Australia would be considered a service seller. Sales representative who sell products, or trainers who deliver training courses, would not be considered a service seller.

With this visa you can:

  • sell, or negotiate the sale of, services for a period of between three (3) and six (6) months
  • bring any eligible secondary applicants with you to Australia – secondary applicants can work and study
  • after entering Australia, have no limit on the number of times you travel in and out of Australia

The validity of the visa is 6 months at a time.
The total visa period granted for Service Sellers cannot be more than 12 months. Service Sellers wishing to stay longer should use Standard Business Sponsorship or Overseas Business Sponsorship.

There are no sponsorship or nomination requirements for this visa.

Salaries and financial support

All salaries and financial support must be paid by the overseas company for the entire length of stay in Australia.

Service sellers must not be employed by a company based in Australia.

Other visa options

Employees who are not eligible for the Service Seller category may be eligible for a Temporary Business (Long Stay) visa under the Standard Business Sponsorship category.

Renewing a visa

If an employee currently holds a Service Seller visa and a renewal is required, a new visa application must be lodged.

Service Seller Eligibility

Applicants applying as a service seller must:

  • be a representative of an overseas service supplier
  • have the relevant skills and experience for the position
  • show that the overseas service supplier is actively engaged in business in Australia, by providing details of:
    • the business activities of the overseas service supplier and their plans to expand their trade in Australia
    • how the service seller proposes to represent the supplier in Australia
    • how the service seller intends to support themself and any family members for the length of their stay in Australia
  • Must meet health requirements for this visa
  • Must meet the character requirements for this visa

The following people may apply to accompany and stay with the employee:

  • • the service seller’s spouse
  • • the service seller’s interdependent partner
  • • dependent child of the service seller, their spouse or their interdependent partner
  • • other dependent relatives of the service seller or their spouse

Obligations

Service sellers must agree not to:

  • be involved in the supply or sale of products
  • engage in work in Australia if the service can be provided by an Australian citizen or Australian permanent resident.

The service seller must notify the department of any change in their circumstances.

If the visa application for a temporary visa is approved, the following work condition will be applied to the employee.

The employee must not:

  • stop working for the employer who sponsored them (that is, become unemployed or change employer)
  • work in a different position other than the position that was nominated in the visa application
  • work for another person or for themselves while working for the sponsor.

If an employee wishes to change employer, a new sponsorship and visa application will be required.
